Additional Terms

1.0 Payment: If the property rental  is made with less than sixty (60) days’ notice, payment in full is required at the time the Cottage Rental Agreement is  submitted unless otherwise agreed.  

1.1. Bookings shall be confirmed in writing via email after payment and a copy of these terms and conditions is received. 

2. Damage Deposit: A damage deposit of $1,000 is taken to ensure that the cottage is left in the same  condition as found, including tiddiness. The  damage deposit is due to the Owners at least 7 days prior to the rental period. Provided there is no  damage and the cottage is left in the same state as upon arrival, the damage deposit will be returned  to the renter within fourteen (14) days of departure. Any damages will be deducted from deposit. 

3. Cancellation by You (Renter): Any cancellation made by you shall be made in writing via email and will follow the refund schedule outlined above.

4. Refunds: You agree that you shall not be entitled to any refund arising from weather,  travel delays / cancellationsl, fire bans, or other  conditions beyond the control of the Owner. 

5. Cancellation by Owner: If the Property is damaged, destroyed or uninhabitable then we may terminate  this Agreement at any time with no prejudice by giving written notice to you via email. All payments that you have  made will be refunded.  

6. Use: You agree to use the cottage for personal vacation use only.

7.0 Repairs by Owner: Every effort will be made to ensure that all the equipment at the Cottage is in good  working order at the time of your arrival. Should there be a problem with the water, plumbing or electrical system or  with a major appliance you are to contact the Owner immediately. We will make all effort to have repairs done in a  timely fashion.  

7.1 Repair by Renters: You agree to keep the Property and all furniture, fixtures, chattels and effects in or on the Property in the same state of repair and condition as at the commencement of the rental period, save and  except for ordinary wear and tear. 

8. Clean Up: You agree to follow the provided Check Out Procedure prior to departure, and  generally leave the Property in the same state in which it was found.  

9. Proof of Insurance Coverage: We recommend that renters have insurance to protect themselves from damages to their personal property.

10. House Rules: All guests (including day visitors) are required to review and follow the house rules posted here. The rules will also be emailed and included onsite as a reminder. 

11. Access: The owner or owner representative shall be allowed to access the vacation property at any reasonable time during any  occupancy. 

12. Limitation of Liability: You acknowledge and agree that you will use the cottage and its facilities in  accordance with the Rental Terms and Conditions and the House Rules and that you do so at your own risk. 

13. Indemnity: The Renter agrees to take reasonable precautions in use of the Property and the Cottage. The  Renters agree that they are responsible for their own safety and that of their family, friends, guests, and invitees. The Owner will not be liable for any  consequential damages, loss or expense arising out of or in connection with the use of the rental property or the  inability to use the rental property for any purpose whatever and the Owner’s maximum liability for all damages, losses  and causes of action, whether in contract, tort or otherwise, shall not in any case exceed in aggregate the contract  price for the rental. In addition, the Renters undertake to indemnify and hold the rental property owner harmless  against any and all loss, injury, claims, causes of action, demands and/or costs and expenses that may be incurred  by the Renters or anyone on or using the cottage or its’ property in relation to the cottage rental.  

14. Legal Proceedings: If you are in default of the terms of this Agreement and it is necessary for the Owner  to take legal action against you, you agree that the Owner shall be entitled to recover all costs and expenses of such  proceedings including legal fees on a substantial indemnity basis. 

15. Entire Agreement: There are no representations, collateral agreements, warranties or conditions except  as set out in this Agreement. 

16. Assignment: You have no right to assign or sublet this Agreement.

17. Online: You agree that this Agreement may be executed online and via email transmission and that digital signatures will evidence the obligation of the parties to be bound by the terms of this Agreement. 

The parties agree that they have read this rental agreement fully and understand the regulations and obligations  provided. It shall be governed by the laws of the Province of Nova Scotia and agree to attorn solely to the jurisdiction of  the courts with respect to any and all disputes arising out of the interpretation and application of this contract  and the relationship between the Owner and the Renter.
